Appeal Court Clarifies Kano Judgement, Cites Typo Error

The Chief Registrar of the Court of Appeal, Umar Bangari, clarified the controversies surrounding the Kano Governorship Election judgment, stating that the discrepancies were typographical errors that do not invalidate or alter the court’s findings and conclusion.

Bangari assured the public that the errors would be rectified upon formal application by the involved parties, referencing Order 23 Rule 4 of the Court of Appeal Handbook, which empowers the court to correct clerical errors. 

There was widespread controversy and various interpretations surrounding the court decision that affirmed the judgment of the Kano State Governorship Election Petition Tribunal, which nullified Kabir Yusuf’s victory from the New Nigeria People’s Party (NNPP) in the March 18 Governorship Election.

The court directed INEC to conduct a fresh election in three local government areas of the state, where PDP’s Lawal and APC’s Bello Matawalle are the key contenders.

On Sunday, the appellate court also removed PDP’s Caleb Mutfwang in Plateau State, instructing INEC to issue a Certificate of Return to APC’s Nentawe Goshwe. 

The court maintained that the party had violated the court order requiring a valid congress in the 17 local government areas of the state.

In the past week, the appellate court removed three governors who had been declared winners by INEC in the March 2023 elections, and all three governors affected belonged to opposition parties.

In Zamfara, the appellate court ousted Governor Dauda Lawal of the Peoples Democratic Party (PDP), declaring the election inconclusive about eight months later.
